Terms of Service

These Terms of Service govern your access to and use of Erdos (formerly Mailflare / “Pointer AI”) — the website, dashboard, and email outreach services we provide. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

1. What Erdos does

Erdos helps students run email outreach campaigns. The service: (a) matches your stated research interests against publicly available faculty and professional profiles using AI; (b) generates draft emails personalized to each recipient; (c) sends emails you approve through your own Gmail account via Google's official APIs; and (d) reports delivery and open activity back to you. Emails are queued and sent gradually in the background rather than instantly.

2. Eligibility and accounts

  • You must be at least 13 years old to use Erdos. If you are under 18, you may use the service only with the consent of a parent or legal guardian.
  • We do not knowingly allow children under 13 to create accounts, consistent with the U.S. Children's Online Privacy Protection Act (COPPA).
  • You are responsible for the accuracy of the information you provide and for safeguarding your login credentials. You must notify us promptly of any unauthorized use of your account.
  • One person per account. You may not sell, transfer, or share your account.

3. Your Gmail account and Google services

  • Connecting Gmail is optional but required to send email. You connect through Google's OAuth consent flow; we never see or store your Google password.
  • Emails are sent from your address, under your name. You are the sender of every message, and you are responsible for its content and recipients.
  • You may disconnect Gmail at any time from Settings or from your Google account security page, which revokes our access.
  • Your use of Gmail through Erdos must also comply with Google's own terms and program policies.
  • Erdos's use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.

4. Acceptable use

Erdos is built for personal, genuine, one-to-one outreach. You agree that you will not use the service to:

  • Send unsolicited commercial bulk email ("spam") or any email that violates the U.S. CAN-SPAM Act, Canada's CASL, the EU ePrivacy rules, or other applicable email and telemarketing laws.
  • Send deceptive, fraudulent, harassing, defamatory, or unlawful content, or impersonate any person or organization.
  • Misrepresent who you are, falsify email headers, or disguise the origin of a message.
  • Harvest or scrape recipient addresses in violation of a website's terms or applicable law.
  • Interfere with, probe, or disrupt the service, attempt to access other users' data, or reverse engineer the platform except where such restriction is prohibited by law.
  • Use the service to build a competing product or resell it without our written consent.

We may throttle, queue, or refuse to send messages, and may suspend or terminate accounts, where we reasonably believe these rules are being violated or where sending would harm recipients, other users, or the deliverability of the service.

5. AI-generated content

  • Email drafts are generated by AI and may contain inaccuracies. You must review every email before it is sent. Approving an email for sending is your confirmation of its content.
  • You retain responsibility for claims made in your emails (e.g., statements about your experience or qualifications).
  • We do not guarantee any particular outcome — including that professors will open, read, or respond to your emails, or that you will obtain any position.

6. Subscriptions, billing, and cancellation

  • Paid plans (currently Pro, Max, and Ultra) are billed in advance on a monthly or yearly cycle and renew automatically until cancelled.
  • You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable and we do not provide prorated refunds for partial periods.
  • Prices may change; we will give you at least 30 days' notice before a price change affects an existing subscription, and you may cancel before it takes effect.
  • Applicable taxes (e.g., VAT, GST, sales tax) may be added based on your location.
  • If you are an EU/UK consumer, you consent to the service beginning immediately and acknowledge that the statutory 14-day withdrawal right no longer applies once digital performance has begun, to the extent permitted by law.

7. Your content and our license

  • You own the content you provide (your profile, interests, resume, and the emails you send). You grant us a limited, worldwide, non-exclusive license to host, process, and transmit that content solely to operate and improve the service.
  • We own the Erdos software, design, and branding. These Terms grant you a personal, non-transferable, revocable right to use the service; no other rights are granted.
  • Feedback you send us may be used without obligation to you.

8. Third-party services

The service depends on third parties, including Google (Gmail APIs and OAuth), our hosting and database providers, and AI model providers. Their availability is outside our control, and their terms apply to your use of their services. Links to third-party sites are provided for convenience and are not endorsements.

9. Termination

  • You may stop using the service and delete your account at any time.
  • We may suspend or terminate your access immediately for material breach of these Terms (including the Acceptable Use rules), for legal compliance, or if the service is discontinued. Where practical, we will give you notice and an opportunity to export your data.
  • Sections that by their nature should survive termination (including licenses to feedback, disclaimers, limitations of liability, and dispute resolution) survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EMAILS WILL BE DELIVERED, OPENED, OR ANSWERED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU; NOTHING IN THESE TERMS AFFECTS STATUTORY CONSUMER RIGHTS THAT CANNOT BE WAIVED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERDOS AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR OPPORTUNITIES (INCLUDING RESEARCH OR EMPLOYMENT OPPORTUNITIES), ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THAT PERIOD OR (B) USD $50. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.

12. Indemnity

You will indemnify and hold us harmless from claims, damages, and reasonable legal fees arising out of your content, your emails, or your violation of these Terms or applicable law (including anti-spam laws), except to the extent caused by our own breach or negligence.

13. Governing law and disputes

  • For users in the United States, these Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Delaware, unless mandatory law in your state provides otherwise.
  • If you reside in the European Union, United Kingdom, or another jurisdiction whose law grants you mandatory consumer protections or a home-court forum, nothing in these Terms deprives you of those protections or that forum.
  • Both parties agree to first attempt to resolve any dispute informally by contacting the other; most concerns can be solved quickly at support@erdos.app.

14. Changes to these Terms

We may update these Terms as the service evolves. For material changes we will give notice (e.g., by email or an in-app notice) at least 14 days before they take effect. Continuing to use the service after changes take effect constitutes acceptance; if you do not agree, stop using the service and cancel your subscription.
